The Limitation is in the Minds of those who are leading the Fatwa Index and not on Muslim Girls
(Translated)

A number of Egyptian newspapers reported on Wednesday, 30/1/2019, what the World Fatwa Index issued on the marriage of minors, claiming that Hizb ut Tahrir restricted marriage to sexual relationship only, disregarding their psychological, health, mental and physical qualifications. The party criticized the opponents of marriage of the “minors”, who allow them to have sexual relations at the early stages of their lives. In its statement the Hizb said: “the presence and spread of sexual relations between the ages of 15 and 18 in Germany is evidence of the existence of instinctive needs in this category, which must be regulated by the right organization that ensures the satisfaction of their needs and ensure the rights and does not spread vice in society”. The strategic studies unit in Dar Al-Ifta (Fatwa House) recommended and demanded that the exceptions to the legal age of marriage to be lifted and that the legal age of marriage for girls is increased to at least 18 years.

It is clear that those who are leading the Fatwa Index have chosen to be part of a systematic war on Islam and its ideas, starting with ruling through to the economy, and the social system ... the destruction of ruling is followed by the destruction of the Ummah's economy and the plundering of its resources. To maintain the plundering and distract the Muslims with their own issues, and to corrupt them from within, they worked on corrupting women which will in turn corrupt men and the whole society. What the men of the index quoted from Hizb ut Tahrir's statement does not harm the party, but rather indicates the elevated understanding and keenness to guarantee the rights and welfare of the society. We wish that they published the rest of the facts in this statement about the number of children born out of fornication in Germany and the extent of this obscene practice according to their studies in that age group. And the burdens of this act, so can the girl under the age of 18 bear the burdens of fornication and does not bear the burdens of marriage?! Also the Hadith of the Prophet (saw) which you mentioned:

«يَا مَعْشَرَ الشَّبَابِ، مَنْ اسْتَطَاعَ مِنْكُمْ الْبَاءَةَ فَلْيَتَزَوَّجْ، وَمَنْ لَمْ يَسْتَطِعْ فَعَلَيْهِ بِالصَّوْمِ، فَإِنَّهُ لَهُ وِجَاءٌ»

“O young men, whoever is able to get married then let him do so, if he cannot then let him fast, it is for him a protection.”

Al-Nawawi said regarding it: “The scholars differed concerning what is meant by the al Ba’ah here, based on two sayings, which refer to one meaning of which the most correct is: the linguistic meaning is intercourse, so his view: is the one who is able to carry out intercourse because of his ability to provide, the provisions of marriage, then he should get married, and the one who is incapable of intercourse because of inability to provide then he must fast to repel his desire, and stop the evil of his semen, as it is a protection". What prevents young people from owning the provisions of marriage? Is it not capitalism that governs our land and make it subordinate to the colonial kafir West to plunder its wealth and resources, and the agents rulers guard its interests and implement its policies in our lands?! Moreover, the provision that you speak about is not required by the Prophet (saw) when he (saw) helped a man get married with what he memorized from the Qur’an, and when he (saw) said to another:

«الْتَمِسْ وَلَوْ خَاتَمًا مِنْ حَدِيدٍ»

“Give a ring even if it is from iron.” And when He (saw) said:

«إِنَّ مِنْ يُمْنِ الْمَرْأَةِ: تَيْسِيرَ خِطْبَتِهَا، وَتَيْسِيرَ صَدَاقِهَا، وَتَيْسِيرَ رَحِمِهَا»

“One of the signs of a woman being blessed is that the process of proposing to her is made easy and the dowry is made affordable and she bears children easily.” [Extracted by Ahmad, Ibn Haban, and Bayhaqi]

And our young girls are not minors, but they only need a state that protects them from the intrusion of capitalism which wants them to be a commodity to trade with and want them to be a block against the return of Islam to rule again in the state of the Khilafah Rashida (guided Caliphate) on the method of Prophethood. The limitations are within your minds, which insist to stand with the wrongdoers and to line up in the ranks of those who fight Allah and His Messenger and His law, and Allah’ saying describes them well:

«أَخْوَفُ مَا أَخَافُ عَلَى أُمَّتِي مُنَافِقٌ عَلِيمُ اللِّسَانِ يُجَادِلُ بِالْقُرْآنِ»

“The thing I fear most for my Ummah is the eloquent hypocrite who debates with the Qur’an.”

As for determining the age of marriage that you have recommended based on a decision passed to you from your masters in the White House, and you searched for an abnormal opinion that contradicts the consensus and used the evidence about the adoption of the guardian that removes the dispute. First, even the saying of Ibn Shubrama, which is odd to the consensus, does not help you, despite that he prevented the young girl from marriage, he did not specify a specific age for her marriage, and he did not say, your lie, that marriage is forbidden for those under 18-year-old. As for the guardian and his adoption, who is the guardian who may adopt?

On the assumption that it is permissible for him to adopt a specific age for marriage, he is the legal guardian who comes to power by a valid legitimate pledge of allegiance and rules the Ummah by Islam. His presidency is general to all Muslims. Otherwise, it is not permissible to describe him as a guardian and he is not obliged to be obeyed and he is not allowed to adopt a Shariah rule that people must follow.

O Al-Azhar scholars! This regime wants you part of the war on your Deen and its ideas and creed and wants you to be a tool to mislead those who entrusted you to their Deen, they will not save you from Allah’s wrath; do not meet Allah in the dress of misguidance. O descendants of the Sultan of scholars Al-Izz ibn Abdul Salam! Why don’t you stand for Allah, and evoke the greatness of Allah in front of you as your grandfather Al-Izz did, and reject the ideas of the West, which the regime demands of you to dress them by Islam and promote them among the people of the Ummah, and work to resume the Islamic way of life by the establishment of the Khilafah Rashida (guided Caliphate) on the method of Prophethood, and ask the people to embrace the idea and work for it, and incite the faithful sons of the Ummah in the armies, to support it. May Allah (swt) write conquest and victory by your hands so that you and the Ummah get the blessings and the people and birds and trees are pleased?! Oh Allah, make it soon and with our hands.

[يَا أَيُّهَا الَّذِينَ آمَنُواْ اسْتَجِيبُواْ لِلّهِ وَلِلرَّسُولِ إِذَا دَعَاكُم لِمَا يُحْيِيكُمْ وَاعْلَمُواْ أَنَّ اللّهَ يَحُولُ بَيْنَ الْمَرْءِ وَقَلْبِهِ وَأَنَّهُ إِلَيْهِ تُحْشَرُونَ]

“O you who have believed, respond to Allah and to the Messenger when he calls you to that which gives you life. And know that Allah intervenes between a man and his heart and that to Him you will be gathered.” [Al-Anfal: 24]
