Germany Exposes Its Double Standards
(Translated)

Since its accession to the United Nations and its signing of the founding treaty of the International Criminal Court (ICC), the Federal Republic of Germany has presented itself as a proponent of international law. However, its stance on the recent arrest warrants issued by the ICC now reveals the instrumental nature of the international system with its alleged rules, sacrificing its credibility on the altar of Zionism.

On November 21, 2024, the ICC issued arrest warrants against the Prime Minister of the Jewish entity, Benjamin Netanyahu, and his former Defense Minister, Yoav Gallant. The Pre-Trial Chamber based its decision on "sufficient grounds to believe that the accused are guilty of committing the war crime of starvation as a method of warfare… murder, persecution, and other inhumane acts." According to Article 86 of the Rome Statute, Germany is obligated to provide "full cooperation and assistance" in prosecuting cases before the ICC. International law expert Kai Ambos stated: "This means that all ICC member states must arrest them upon entering their territories... Germany must arrest Netanyahu, just as it would with Vladimir Putin. It is the same law, so they must be treated the same way."

Prosecution also has implications for arms supplies. By militarily supporting the entity, Germany "may assist in committing such crimes."

Conversely, on November 22, the government’s press office announced that the federal government had "taken note" of the ICC’s decision. It stated that "domestic steps will now be thoroughly examined, and no further action will be taken unless Netanyahu and Gallant are expected to enter German territory." Here too, the government justified its position by invoking the Holocaust, stating in its press release that although Germany "is one of the strongest supporters of the ICC, due to German history, there is a unique relationship and great responsibility that binds us to ‘Israel’."

For its part, the CDU/CSU parliamentary group in the Bundestag declared that "it is inconceivable for the democratically elected Prime Minister of the State of ‘Israel’ to be arrested on German soil." Meanwhile, Nils Schmid, the foreign policy spokesperson for the SPD parliamentary group, suggested "using the scope of diplomacy and meeting Netanyahu in (Israel) or the United States to avoid arrest."

With this stance, Germany exposes the instrumental nature of so-called international law and institutions. Western countries and other major powers only use them when it suits their interests. For example, former Justice Minister Marco Buschmann declared last year: "Germany is obligated to arrest President Putin if he enters German territory and hand him over to the ICC." Yet today, no similar statement has been heard from any government officials, prompting even some German commentators and journalists to speak of "hypocrisy and double standards."

What makes the matter worse is that the German government's double standards are justified by an authoritarian concept of supreme national interest. Whereas the logic of supreme national interest was previously used—in harmony with international law—as a tool to rehabilitate "modern Germany repenting for Nazi crimes," it increasingly represents an absolute foundation of political action today, upheld under all circumstances, even at the risk of damaging the state's reputation and genuine national interest.

Hizb ut Tahrir warns the German government once again about the dire consequences of this irrational stance. Germany stands on the threshold of a new geopolitical era in which the Jewish entity will become a thing of the past. The soon-to-be-established Khilafah (Caliphate), with Allah’s permission, will hold to account all those who supported the genocide in Palestine, whether politically, economically, militarily, or morally!
