The Law of Eradication of Terrorist Financing
Finally, through the preliminary session held on Tuesday (12/2), the House of Representative approved the Bill of Prevention and Eradication of Terrorism Financing to be law. The discussion process of this bill was away from the media reporting and public attention.
The bill that was prepared to position Indonesia as an internationally participating country in suppression of the financing of terrorism is a consequence of the law number 6, 2006 about the International Convention for the Suppression of the Financing of Terrorism, 1999 and The sheet of Republic of Indonesia number 29, 2006, and the additional Sheet of Republic of Indonesia number 4617. However, this bill is problematic. The proposed law can give chance to abuse of power. The financing of innocent parties will be blocked or confiscated. Furthermore this proposed law will raise new problems and create a climate of suspicion in financial transaction. Public must be worried.
There are some points of the proposed law must be criticized, first, giving chance to abuse of power. The term ‘Should be suspected" in connection with terrorism in article 1 verse 1, article 1 verse 7, article 2, 3 and 4. This term is absurd and ambiguous. There is no clarity about who has right to decide of this "Should be suspected". Unclear criteria will open chance for abuse of power. Second, the bill can raise new problems; hampering the smoothness of transaction mainly the big scale transaction. Finally it will have an effect on economic activity. Third, all of these provisions can harm everyone. For example, in article 1 about criteria of the financing of Terrorism is unclear, so it can target everyone and it is possible to be influenced or dictated by foreign interests considering the definition of terrorist is still unclear.
Regarding this issue, Hizb ut Tahrir/ Indonesia declares:
1. Reject the Law of Prevention and Eradication of Terrorism Financing (UU P2TP2T) because the law will potentially endanger people in common and the Muslim Ummah in particular, more specific to Islamic organizations and Islamic dawah movements as the consequence of abuse of power and unclear definition of terrorist, criteria of terrorist, and the limit of financing. To date, the Law Number 15 2003 about the eradication of terrorism has put Muslim under tyranny. They are to be victims of wrongful arrest and wrongfully shot led by special police for eradication of terrorist (DENSUS 88), so the presence of this Law (UU P2TP2T) will create new tyranny and worsen. Based on this Law the Security Council will block accounts arbitrarily. And anyone may be suspected of involvement in terrorist activity because of proof of financial transaction with someone who is suspected as terrorist. The impact will be terrible if this condition happen.
2. Actually, our need now is how to re-manage the thinking frame correctly about whom is really the greatest threat to this country and how to handle it. From the fact we can understand that the greatest threat to this country is imperialism of imperialist countries such as US and its allies that have dominated all aspects of life mainly political and economic fields. Actually, the great energy of this country must be mobilized and directed to face the power of imperialism.
3. Call on all Muslims wherever they are to work seriously for establishment Shariah and Khilafah "Caliphate". Be sure, only Khilafah "Caliphate" can realize Islam Rahmatan lil 'Alamin as Allah (swt) promises. And only Khilafah "Caliphate" can protect Muslim dignity and the sovereignty of Muslim lands including Indonesia from the real terrorist, the power of imperialism. Inshaallah.
