In Democracy, Laws of the Creator of Heavens and Earth are Held in Contempt!

The Cabinet has ascended to the marriage bill under the name 'Come We Stay' which states that if a man and a woman stay together for a period of six months, they will be recognized in law as married couples and even chiefs will be compelled to issue them with marriage certificates. The said bill to be debated in parliament soon either suggests that it is not a must to give dowry to a woman. Hizb-ut Tahrir / East Africa views this bill demonstrates the following:

1. The true face of the problematic colonialist and democratic politics that give human beings the authority to create laws which give rise to repression and abuse of women who are a vital pillar in caring for the whole society.

2. Promiscuity is given a new garb under the law. This filth is a great contributor to the infection rates for diseases like syphilis and AIDS which continue to devastate thousands of energetic youths in society.

3. The continuation of abuse of women e.g. If a dispute arises between a man and a woman before the lapse of six months yet the woman is pregnant and the man decides to deny responsibility and runs away, what then should be expected if not abuse of the woman by being overburdened by the pregnancy and thereafter children who lack guardians thereby turning into delinquents.

4. Humiliating the honour of a woman by denying her dowry therefore this law has revealed the lies of democracy that it is in the forefront of liberating the woman. The truth is what has been revealed in this law i.e. democratic laws are actually the main cause of oppression of the woman and stripping her of honour given to her by her Creator.

5. This law has contempt for Islam. It is very important to understand that Democracy does not simply mean voting in elections as many understand. Rather, it has been designed to counter the laws of the Creator. Therefore, it is no surprise for the believers in Democracy to have contempt for Allah (swt) and His laws and carry simplistic thoughts that religious laws are stringent and are contrary to the lives of human beings!

In conclusion, Hizb clarifies that Islam regards staying together of a man and a woman for any period whatsoever as promiscuity (zinaa) and a great sin that should be avoided in all its manifestations. Islam also commanded giving dowry as respect and a gift to a woman in marriage which permits the man to stay with her. This Islamic law is intended to protect the dignity of a woman contrary to problematic Western ideology which leads a woman into sex trade and abuse by men. Let it be known to all that many problems will continue to be witnessed in Kenya as society is not led by Islamic morals but by the Western and Capitalist ideology which permits everything under the slogan of freedoms and democracy. At the same time, it prohibits anything that is contrary to it. We state that this bill has openly shown the weakness of man-made laws as to how they contradict and create new problems!
