Hizb ut Tahrir East Africa, have neither faith nor confidence in the guile plan by the Zanzibar Government of National Unity heinous attempts of raising a motion to the parliament under the guise of improving Kadhis Court performance. We strongly condemn any attempts meant to impose what is termed as amendments to the gender degradation laws, which in quiddity are meant to divide the assets of previously married couples on equilibrium basis soon after separation [division of matrimonial assets]. A move that categorically contradicts the sublime Islamic teachings consequently undermines Kadhis Court remit.

These Government of National Unity deceitful moves, tantamount to all other law motions, just like the law of a child of 2011, it is sheer political pressure from foreign nations [as reported by Mwananchi News Paper on June 4, 2010, pg 1&4]. These plans were also propelled by internal cronies, the so called activists and social organizations that associate themselves with the fight for women's rights including ZAFELA [Zanzibar Female Lawyers]

We blankly declare that, despite many crafty plans and objectives, these moves are apparently meant to obliterate the small and meager portion remaining of the Islamic social and matrimonial, laws of inheritance and a child custodianship, crippling and destabilizing the Kadhis Court if not removing it completely

Oh Muslims of Zanzibar! Specially the Sheikhs, Imams and Scholars!

A devoted and caring parent always does not feel tired of their parenthood duty. We, Hizb ut-Tahrir, would like to cautiously remind you as we did last time in 2011, when the child law campaign were at the pitch and eventually made into a law. A burdensome and wicked law which will forever inflict pain, problems and a magnitude responsibilities in the history of these Islands.

Are you all aware that among other heinous things these laws recognize the fatherhood of a child could be determined and established by DNA tests? Do you know that these laws recognize marriage based on other than Islam? same sex marriages? Can't you see these will unlawfully empower and enable those who are Islamic ally unfit to inherit be considered as heirs? Can't you see this will encourage oppression and transgression until the Day of Reckoning?

The ongoing campaign against Kadhis Court is but a foreign campaign which continues in Kenya, Tanganyika and which is a long term project in Zanzibar ostensibly under the pretext of many scrupulous plots including the so-called improvement of the of the concerned department dealing with women and children issues in order to remove these responsibilities from Kadhis Court. under the guise of passing new laws. All these are done under the motto of liberation, improvement, redemption of women and children from oppression all these are deceitfully done when the innocent people are made busy for fruitless issues. That's precisely how they took advantage of the unaware people and passed into law the 2011 child law without any substantial resistance nor stiff opposition as people were concentrating on the fruitless democratic issues.

Finally, Hizb would like to warmly call all the Muslims generally and especially the Sheikhs, Imams, Scholars to adhesively stand their ground with the Hizb against this temptation and criticize openly on podiums all these wicked and heinous attempts in an Endeavour to make Ummah perceive the reality of the enmity which is surrounding them.

Also, we call upon politicians and legislators who clamour for the obliteration of the Kadhis court for their own meager worldly selfish gains to wake up and stop putting on a shameful humiliating gown in their history. They are part and parcel of the Muslims Ummah thus they ought to fear Allah Taala and not be enticed by small worldly gains and later face eternal destruction hereafter.

((يَاقَوْمِ لَكُمُ الْمُلْكُ الْيَوْمَ ظَاهِرِينَ فِي الأَرْضِ فَمَنْ يَنصُرُنَا مِنْ بَأْسِ اللَّهِ إِنْ جَاءَنَا))
