WHICH IS BETTER TO SUBMIT TO: DIVINE LAW OR THE RULING OF IGNORANCE BASED ON THE WHIMS OF MAN?
The Commission for Implementation of the Constitution (CIC) introduced the new marriage bill which proposes that the banning of payment of Dowry as well as men contracting more than one marriage! The Islamic party Hizb ut-Tahrir East Africa is not surprised at such foreign proposals but feels sadly that this bill is constantly harassing the dignity of the women and continuing the attack on Islam. As for not being surprised by the contents of this bill, this it is because Kenya is among those countries in the world which has adopted the western creed of detaching religion from life affairs (Secularism). This doctrine was initially established in Europe as an experimental solution claimed to liberate the common people who were experiencing injustice and oppression from tyrannical kings in cooperation with a corrupt Christian clergy. This oppression led to an intense debate among western philosophers who finally concluded secularism should be a new alternative. This creed defined that religion must be separated from the state i.e. man should have an absolute sovereignty to legislate while ignoring divine revelation. The founders of this corrupt and apostate thought assert that they are not denying religion nor the existence of the Creator. However, they strictly insist upon separating the Creator from worldly affairs while delegating the authority of the state to human beings and manmade institutions such as Parliament to legislate laws. Due to this, controversial debates have emerged all over the world on Islamic laws/rulings related to all aspects of life including inheritance, marriage and minarets. Currently we have witnessed the French government banning the Hijab (head scarf). Switzerland banned building of the minarets etc all as part of the western civilisational onslaught against Islam led by the head of disbelief, USA, under the guise of the ‘war on terror'. Similarly in Kenya which is still slavishly tied to the colonial capitalist ideology, the new Kenyan constitution (like the old one) is secular and thus many things banned by divine law have been legalized such as interest/usury, wine, fornication etc. In the western world, ‘homosexual rights' is the current fashion and in the near future Kenya may follow the suit and as the new chief justice indicated that the rights of gay and lesbian should be protected! Yet, ironically, at the same time they want to ban dowry and say that Islam retards women's dignity; how crazily they judge!
In the Islamic perspective, marriage between men and women is a divine ruling of and this point should be understood by all. Marriage is the basis of a unique social system that binds a man and a woman into a strong bond and honour the woman status. Allah, the sole creator of the universe, knows and understands our needs/interests far better than we do and He has allowed polygamy and obliged men to pay the dowry. These are definite Islamic rulings which cannot be debated and anyone who assaults them is, like the West, engaged in open war against Islam. Under the western colonial capitalist system, women today are overwhelmingly exploited for their femininity and depicted as sexual objects. This is happening because humanity today worships its lusts and has distanced itself from the correct Islamic social system which guarantees harmony and preserves woman dignity. The Hizb openly opposes this exploitative western culture and exposes its filth as this culture is the prime source of evils engulfing every aspect of life. As for the promoters of this bill, they are promoting the continued oppression of women who are mere playthings under the destructive Western culture which views her has mere commercial and sexual object under the false guise of ‘women's liberation'. The critical and real question that all persons of sanity must address here is: Is it better to follow the guidance from the sole Creator or laws enacted by weak fallible human beings who cannot even guarantee their very own breath?
[افحكم الجهلية يبغون ومن احسن من الله حكما لقوم يوقنون]
"Is it the law of ignorance that they seek? And who is better than Allah in judgement/legislation for those who have conviction?" [TMQ 5:50]
