Regime Legitimacy is Decided by Islam and Not by the Elections based on a Secular Constitution
(Translated)
Starting from Monday 13/4/2015, and for a period of three days, the government in Sudan has occupied the people with elections to choose a president and members of parliament; it gave state employees a holiday on the first day of elections, to enable them to exercise their constitutional right to vote as it claimed.
These elections are held in accordance to the amended secular constitution of Sudan of 2005 (Nevasha); which seceded South Sudan, and prepared the rest of the regions for division. This government's term ends this April according to this constitution, and therefore elections must take place to choose a President of the Republic and members of parliament, who will take through these elections an alleged legitimacy.
We in Hizb ut Tahrir / Wilayah of Sudan and out of our basis of compliance to the rules of Islam we wish to elude the following facts:
First, the legitimacy of the regime is decided by Islam, not by the elections on the basis of a secular constitution that the country is ruled by, as the sovereignty belongs to the Shariah and the authority belongs to the Ummah. The Ummah chooses a man who fulfills the conditions of the bay 'ah contract to give him the pledge on the Book of Allah and the Sunnah of His Messenger (saw), and takes care of the Ummah's affairs by the rules of Islam, and his right is to be obeyed and receive advice and accounting if there were shortcomings from him in taking care of their affairs, or in misapplication of Islam. In Islam there is no President of a Republic who is employed and paid a salary, and governs by other than what Allah has revealed (by man-made constitutions). Allah (swt) says:
(وَمَنْ لَمْ يَحْكُمْ بِمَا أَنْزَلَ اللَّهُ فَأُولَئِكَ هُمُ الظَّالِمُونَ)
"And whoever does not judge by what Allah has revealed - then it is those who are the disbelievers" [Al-Ma'ida: 44]
Allah (swt) says:
(فَلا وَرَبِّكَ لا يُؤْمِنُونَ حَتَّى يُحَكِّمُوكَ فِيمَا شَجَرَ بَيْنَهُمْ ثُمَّ لا يَجِدُوا فِي أَنْفُسِهِمْ حَرَجًا مِمَّا قَضَيْتَ وَيُسَلِّمُوا تَسْلِيمًا)
"But no, by your Lord, they will not [truly] believe until they make you, [O Muhammad], judge concerning that over which they dispute among themselves and then find within themselves no discomfort from what you have judged and submit in [full, willing] submission" [An-Nisa: 65]
Second, in Islam there is no parliament where people are elected to legislate what Allah has not decreed, deciding the halal and haram by the majority, but there is an Ummah's Council, where people choose its members to serve as their representatives in accounting the rulers, and give advice to the Khaleefah for the good of the Ummah. But they have no right at all to legislate as in the parliaments today, that imitates the kafir West; which separated religion from life.
Third, what crippled this country, and made it fall back into the tail of the countries of the world, is the absence of the right political idea; that people are governed by in this country populated by Muslims, and the affairs are taken care of by justice and fairness. Despite the apparent and hidden wealth, so we were caught up in a vicious circle since the departure of the Kaffir colonialists with its armies, while its idea, politics and systems remained, and were followed until today, violating the doctrine of the Ummah, and that which emanates from it from the systems of life that Allah wanted for mankind.
As Muslims the duty upon us is to reject Western Kafir systems and its ideas in government and politics, and return to our Islam, and take the constitution for our lives from it, and the rules of our systems, which its foundations were laid down by our beloved Prophet (saw), and were followed by the guided Khaleefs.
Instead of wasting the Ummah's efforts, money, and time in the imitation of the Kaffir West to establish absurd elections with predetermined outcome, Hizb ut Tahrir invites you to work to resume the Islamic way of life by establishing the guided Khilafah "Caliphate" upon the method of Prophethood; with it, you will please your Lord, and by it you will gain the happiness in the world and the Hereafter.
