Prosecuting Judges is an Inevitable Result of Man-Made Systems and the Rule of Whims

President Kais Saied dismissed 57 judges by presidential order on charges of “corruption, collusion, and covering up suspects in terrorism cases.” We in the Media Office of Hizb ut Tahrir / Wilayah Tunisia explain the following:

1. This matter is part of President Kais Saied’s desperate attempts to control the judiciary in order to eliminate his political opponents, after he failed to recruit the Supreme Judicial Council despite the replacement of a new council on 12/2/2022.

2. The presidential orders and decrees confirm legislative absurdity under man-made regimes that serve only the whims of a tyrannical ruler or a group of lobbies, political professionals and their masters from abroad.

3. The judges today are waging a historical battle in the face of the desperate attempts to domesticate the judiciary by the ruling junta. Their battle is not about a loaf of bread and monthly dues as portrayed by the backward media, but rather it is a fateful battle to preserve what remains of the revolution’s gains and prevent the return of the judiciary to instructions. They represent the last bastions of steadfastness and resistance, and today they are facing a historical entitlement: either they persevere in order to guarantee the rights of the people and achieve the goals of the revolution, or they submit to injustice and contribute to the restoration of the police state more than it was during the era of Ben Ali, which neither we nor the people of Tunisia, or the future generations are satisfied with.

We in the Media Office of Hizb ut Tahrir / Wilayah of Tunisia address the judges with this open letter dated 8 Dhul Qi’dah 1443 AH corresponding to 7 June 2022 CE. We put in their hands a political and media position regarding ensuring the existence of a judiciary free of corruption and discrimination, that preserves people’s rights and is firm in accounting the rulers, so that our people in Tunisia, especially judges, scholars, men of fiqh and law, see the greatness and justice of Islamic legislation to put it into practice and implementation.

Allah (swt) says:

[إِنَّ اللهَ يَأْمُرُكُمْ أَن تُؤَدُّوا الْأَمَانَاتِ إِلَى أَهْلِهَا وَإِذَا حَكَمْتُم بَيْنَ النَّاسِ أَنْ تَحْكُمُواْ بِالْعَدْلِ إِنَّ اللهَ نِعِمَّا يَعِظُكُم بِهِ إِنَّ اللهَ كَانَ سَمِيعاً بَصِيراً]

“Indeed, Allah commands you to render trusts to whom they are due and when you judge between people to judge with justice. Excellent is that which Allah instructs you. Indeed, Allah is ever Hearing and Seeing” [An-Nisa: 58].
