Laws of Islam are Unambiguous and Easy to Apply through the Judiciary of Islam
Chief Justice of Pakistan Asif Saeed Khosa on 13 April 2019 said that parliament did not accord priority to the justice system ….It is for the state and the legislature to come up with laws which should be clear, unambiguous and easy to apply,”. He was addressing a conference being organized at Federal Judicial Academy.
In order to deliver justice, good laws and an effective judiciary are indeed important. In Pakistan, justice has not been delivered. The basic reason is that the laws and judiciary implemented in Pakistan were left by the British Raj. The laws and judiciary are based on the secular creed which is Kufr. The Muslims of the Indian Subcontinent struggled for the creation of Pakistan, so that they are liberated from the Kufr system and Islam is implemented in every aspect of life. However, unfortunately after the creation of Pakistan, Islam has not been implemented in any field of life, including the judiciary. The laws made by humans and then a judiciary implements these man made laws. Thus it can never provide swift, easy and affordable justice. If all humans come together, even then they cannot make clear and unambiguous laws for all the issues faced by humans. That is why all over the world people complain about the judiciary. They see that there are contradictions in laws. The laws are not easy to understand. And the judiciary does not provide easy and swift justice.
In order to have clear, unambiguous and easy to implement laws, we cannot depend on the parliament as it is incapable to provide that. Allah (swt) has given all the laws in Quran and Sunnah. These laws resolve all human problems for all generations to come, until the Last Day. The 1300 year history of the Khilafah state (Caliphate) reveals that its laws and judiciary provided easy and swift justice. The laws of Islam and its judiciary were so effective that non–Muslims were impressed by them. Thus, non-Muslim citizens of the Khilafah state brought their matters in courts to be settled according to Islamic laws, even though they were allowed to settle their religious affairs according to their own religious laws, such as in the issues of marriage, maintenance and inheritance. Allah (swt) has explained that Islamic laws are easy to understand. Allah (swt) said,
[وَلَقَدۡ يَسَّرۡنَا الۡقُرۡاٰنَ لِلذِّكۡرِ فَهَلۡ مِنۡ مُّدَّكِرٍ]
“And We have verily made the Qur’an easy to understand and receive admonition. Then, is there anyone who will receive admonition?” (Surah al-Qamar 54:17). Similarly Allah (swt) described that the laws of Islam are comprehensive and nothing has been left which humans may come across. Allah (swt) said,
[وَنَزَّلۡنَا عَلَيۡكَ الۡـكِتٰبَ تِبۡيَانًا لِّـكُلِّ شَىۡءٍ]
“And We have sent down to you the Book as clarification for all things” (Surah An-Nahal 16:89). Allah (swt) said that the implementation of the laws of Islam are for the betterment and guidance of humans. Allah (swt) said,
[اِنَّاۤ اَنۡزَلۡنَا عَلَيۡكَ الۡكِتٰبَ لِلنَّاسِ بِالۡحَقِّ فَمَنِ اهۡتَدٰى فَلِنَفۡسِه وَمَنۡ ضَلَّ فَاِنَّمَا يَضِلُّ عَلَيۡهَا]
“Indeed We have sent down unto you [for your Guidance] the Book [the Holy Qur’an] for mankind in truth. Therefore, whosoever accepts the Guidance, it is only for his ownself, and whosoever goes astray, he goes astray only for his [own] loss.” (Surah Az-Zumar 39:41). And Allah (swt) has made it obligatory that we must decide matters according to what He swt has revealed. Moreover, whosoever not decide matters according to what Allah swt has revealed is an oppressor. Allah (swt) said,
[وَمَنۡ لَّمۡ يَحۡكُمۡ بِمَاۤ اَنۡزَلَ اللّٰهُ فَاُولٰٓٮِٕكَ هُمُ الظّٰلِمُوۡنَ]
“and whoever did not judge by what Allah revealed, those are they that are the unjust” (Surah Al-Maidah 5:45).
So the state officials, elective representatives and court officials do not need to struggle to find easy and unambiguous laws. They must revert to Islam, the Deen of Allah (swt). Allah (swt) has declared Islam a Deen and blessing for us. Allah (swt) said,
[اَلۡيَوۡمَ اَكۡمَلۡتُ لَـكُمۡ دِيۡنَكُمۡ وَاَتۡمَمۡتُ عَلَيۡكُمۡ نِعۡمَتِىۡ وَرَضِيۡتُ لَكُمُ الۡاِسۡلَامَ دِيۡنًا]
“This day have I perfected for you your religion and completed My favor on you and chosen for you Islam as a religion” (Surah Al-Maidah 5:3). The Deen of Islam and its judiciary can never be implemented through Democracy or any other man made system. The Deen of Islam and its judiciary is only implemented through the Khilafah (Caliphate) on the Method of the Prophethood, for which every Muslims must strive.
Without the Comprehensive Implementation of Islam, Pakistan cannot Escape Crises
The Prime Minister, Imran Khan, on 17th April 2019 said that the testing times currently being faced by citizens would end soon. He claimed the country would emerge stronger from the ongoing crisis. He said the biggest impediment to a prosperous new Pakistan was those benefitting from the current system.The government, Imran added, aimed at turning Pakistan into a welfare state.
Definitely the people of Pakistan are facing a tsunami of inflation. Their buying power is vanishing. The prices of electricity, gas, medicines are not stabilizing at any one point and the value of Pakistan’s Rupee is depreciating. Under this crisis situation, the “regime of change” has so far not presented any alternate plane to the people. The regime is demanding people remain patient and eat one bread instead of two. It is employing the same tactics to get out of the economic crisis which were used by previous regimes. Thus, it is resorting to internal and external loans, including another IMF program. The “regime of change” says that the biggest hurdle to change current situation are those people who are benefitting from the current corrupt system. However, the ruling PTI itself welcomed those corrupt elements to join its ranks so it can win elections. So unless the PTI does not cleanse its own ranks of these corrupt elements that are hurdles for change, how can it ever bring change?
In fact, there are not only a few people that are benefitting from the current system. The entire political elite is benefiting from this system as democracy allows them to fulfil their personal interests. The common people are continuously forced to give illegitimate non-Islamic taxes from their Halal earning, becoming poor. However, those who have usurped billions through corruption get amnesty schemes to make their black money, white. Every government in the last seventy years has done similar because in capitalist democracy this is always the order of the day. If Pakistan could not get of crises through these measures in all this time, then how will they work now such that Pakistan emerges as a strong, state?
Change cannot be realized through democracy and the capitalist system. The way for real change is the establishment of the Khilafah (Caliphate) on the Method of Prophethood which implements Islam in every field of life. Only the economic system of Islam can bring Pakistan out of this crisis and make it strong. When Muslims implemented Islam comprehensively for thirteen centuries, they became strong in every field and people enjoyed an era of prosperity. The Indian Subcontinent fared so well that it caught the eyes of the greedy British colonialists. The Muslims of Pakistan must not be deceived by false promises of the rulers. They must reject them without wasting any more time and become part of the movement for establishing Khilafah in Pakistan. Allah (swt) said,
[قُلۡ اِنَّ هُدَى اللّٰهِ هُوَ الۡهُدٰىؕ وَلَٮِٕنِ اتَّبَعۡتَ اَهۡوَآءَهُمۡ بَعۡدَ الَّذِىۡ جَآءَكَ مِنَ الۡعِلۡمِۙ مَا لَـكَ مِنَ اللّٰهِ مِنۡ وَّلِىٍّ وَّلَا نَصِيۡرٍؔ]
“Surely Allah’s guidance, is the true guidance. Should you follow their desires disregarding the knowledge which has come to you, you shall have no protector or helper against Allah” (Surah Al-Baqara 2:120).
Pakistan’s Woes will only be Solved by Implementing the Commands of Allah (swt), not IMF Bailout Packages
On 13 April 2019 Dawn newspaper published Asad Umer’s statement that while he was on his US tour, the situation was similar to that of 1988, 1999, 2008, 2013 and 2018. This statement implies that there is some fault in the system and therefore the government is working to make changes in the system. However, this fault is not in any specific part of the system. In fact the entire capitalist system is at fault and the root cause of all woes. Twenty one times Pakistan went to the IMF. It is always for the same reasons that there is trade imbalance and current account deficit.
The basic reason for these problems are that the world currencies are tied to the dollar in international trade. Therefore every country has to maintain Dollar reserves. It has to take measures that ensures the supply of dollars, even if it produces negative effects on economy. So states sometimes devalue the Rupee to strengthen the Dollar. Sometimes they sell off public enterprises to preserve dollar reserves. When the economy of the state is ruined because of these measures, it goes to the IMF to bolster dollar reserves, allowing the IMF to further ruin the economy. The rulers go to the IMF, even though institutions like the IMF do not allow an economy to stand on its own feet. The IMF maintains dollar hegemony and protects American interests. It attaches crippling conditions, such as increasing the prices of electricity, gas and fuel, as well as increases in taxes and removal of subsidies. The IMF asks to devalue the currency and re-orientate the economy so that exports can be increased. This results in an export oriented economy and focus shifts from fulfilling local needs to foreign needs.
Thus the economy favors cash crops like cotton instead of wheat, because there is a demand in the international market. By doing so the production of wheat, which is a prime need of a country, is over looked. Thus, despite having the capacity of to become self-reliant in agricultural commodities, Pakistan imports food stuff. Similarly the IMF asks to export specific industrial goods, like textiles. However, Pakistan does not manufacture its heavy machinery and so imports, which results in an ever growing trade deficit. These measures increase our dependence on imports and allows the IMF to keep interfering in our matters. If Pakistan’s relationship worsens with the Western states, or if they want to use us to secure their interests, they impose bans on our exports. When Pakistan conducted nuclear explosions in 1998, these countries imposed sanctions and our exporters incurred heavy losses. So they use trade sanctions or loan repayments as a weapon. Our rulers use it as an excuse for slavery to the West, claiming that if we do not accept their demands then our economy will be ruined. When Allah (swt) stopped the entry of disbelievers into al-Masjid al-Haram, some people thought that it will hurt their economy but Allah (swt) said,
[يَا أَيُّهَا الَّذِينَ آمَنُوا إِنَّمَا الْمُشْرِكُونَ نَجَسٌ فَلاَ يَقْرَبُوا الْمَسْجِدَ الْحَرَامَ بَعْدَ عَامِهِمْ هَذَا وَإِنْ خِفْتُمْ عَيْلَةً فَسَوْفَ يُغْنِيكُمْ اللَّهُ مِنْ فَضْلِهِ إِنْ شَاءَ إِنَّ اللَّهَ عَلِيمٌ حَكِيمٌ]
“O Believers, those who associate others with Allah in His Divinity are unclean. So, after the expiry of this year, let them not even go near the Sacred Mosque. And should you fear poverty, Allah will enrich you out of His bounty, if He wills. Surely Allah is All-Knowing, All-Wise.” (Surah at-Tauba 9:28). Pakistan’s economic woes will only be ended by implementing the commands of Allah (swt), not IMF bailout packages. This will only happen in the Khilafah as the Khilafah state implements Islam alone. Islam linked currency with gold and silver, so the state does not have to ensure dollar reserves. Gold and silver backed currency establishes stable currency exchange rates. Thus, foreign states are not able to impose their hegemony over us. Allah (swt) said,
[وَلَنْ يَّجْعَلَ اللّٰهُ لِلْكٰفِرِيْنَ عَلَي الْمُؤْمِنِيْنَ سَبِيْلًا]
“and He will not allow the unbelievers, in any way, to gain advantage over the believers” (Surah An-Nisa 4:141).
