Punishment for Contempt of the Prophet Muhammad (saw)

Johor Bahru 1 March, more than 500 Muslims gathered in Masjid Jamek Bandar Baru Uda to protest against the blasphemy against the Honourable Messenger Rasulullah sallahu wa alahi salaam by certain individuals. The peaceful protest was organized with the help of political parties and non-governmental organization (NGO) which took place for more than an hour and half.

In the new chapter of New Malaysia, it is evident that the kuffar in this country have become more vocal and bolder in their attacks and insults against Islam which affects the sensitivity of Muslims. They are not intimidated by certain punishment laws which they are bound to face if convicted. This shows that the laws in the country are not deterrent for the kuffar to launch their attacks and insults against Islam, which is the official religion enshrined in the constitution.

The question arises why in a country, where Islam is the religion enshrined by the constitution since its formation in 1957, there are individuals who have the audacity to attack and insult Islam and Rasulullah saw).

This is because the laws of the country are not derived from Islam but they are secular laws. Secularism separates the religion from the state, and is the basis of liberalism which guarantees the freedom of actions and thought, even when they are false. Indeed, the laws of the country do not place any importance of the laws of the Creator (Ahkam Shariah) to be implemented, therefore Malaysia is a secular country though Islam is the official religion.

It is known from the Ahkam Shariah, according to the scholars of Islam, any intended insult against Rasulullah (saw) is punishable by a mandatory death sentence. The evidence of this is from Rasulullah(saw) and not through ijtihad of the scholars. And the hukum for this ruling is qati’e (definite) and unchanging. There are evidences which prove that any insult against the Honourable Messenger Rasulullah (saw) is punishable by a mandatory death sentence.

It is reported in the kitab Nailul Authar volume VII pages 213-215 that, “Ali Bin Abi Talib reported that a Jewish woman who always insult Rasululullah (saw). Therefore the woman was strangled to death by a man who was infuriated with the insults. And Rasulullah (saw) made is permissible”. (This hadith is also reported by Abu Dawud).

Other than that, Abdullah bin Abbas reported that there was a blind man whose wife insults Rasulullah (saw). The man had warned his wife of her actions but the woman did not stop her attacks. The man got infuriated and stabbed his own wife to death. The next day, revelation was sent down to Rasulullah (saw) explaining the incident. Rasulullah (saw) gathered the Muslims around him and told: With the name of Allah (saw), the man who performed his actions has indeed performed the correct action. The blind man stood and walked to the front of Rasulullah (saw). The blind man told: Oh Rasulullah (saw), I am the man who killed the woman. I am the husband who killed the woman. I killed her because she insulted the Messenger of Allah (saw). I had advised her but she persisted in her insults and that is the reason I killed her. Upon hearing this, Rasulullah (saw) said, «اشهدوا أن دمها هدر» “Bear witness that the blood of the woman is permitted”. (Hadith narrated by Abu Dawud and An-Nasa’i)

It is clear that the death sentence is mandatory against the person who insults Rasulullah (saw). Therefore, the Muslim Ummah must admonish the ruler to implement the laws of Ahkam Shariah which could preserve the honour of Islam and Rasulullah (sawsaw).
