The Military Judiciary in Tunisia Violates all Constitutional Rules and Legal Barriers
to Prevent Hizb ut Tahrir from Speaking the Word of Truth

Despite suffering from the invasions of the Mongols, Tatars, and Crusaders, as well as the Inquisition in Andalusia, the Islamic Ummah, throughout its history filled with tragedies, has never known an enemy that slaughters its sons and opens the gates of hell upon it—while its own rulers prevent their rescue, standing as a barrier that prohibits them from supporting their brothers even with a truthful and sincere word!

At the end of last week, the military court in Tunisia initiated a criminal case against Ustaaz. Mohamed Nasser Chouikha, a member of the Media Office of Hizb ut Tahrir in Wilayah Tunisia, over a journalistic article he wrote for At-Tahrir newspaper. In the article, he warned decision-makers and military forces in Islamic countries against participating in the periodic military exercises conducted by the United States in Tunisia alongside North African countries and Mediterranean nations, given its open declaration of hostility toward Muslims in general and particularly toward our people in Gaza.

Did the former U.S. Secretary of State Blinken not say during his first visit to the Jewish entity after October 7, 2023 that he came as a Jew and not as his country’s foreign minister? Did the U.S. administration not declare at every stage of the siege that it was committed to defending the Jewish entity, sending its fully equipped fleets and troops to blockade the Middle East? Did it not fund the war and participate on the ground—along with its Western colonial crusader allies—in exterminating our people in Gaza, destroying their homes, displacing them, and forcing them into exile? Did it not even threaten to open the gates of hell if they did not submit and surrender to Netanyahu and his gang? Could an enemy be any clearer than this?!

Yet, despite its blatant oppression before the world and history—branding the rightful resistance fighters as terrorists while portraying the usurpers who came from the diaspora as victims; despite its disregard for Muslim blood and its complete indifference to the lives of elders, women, and children; and despite Tunisian President Kais Saied’s declaration and insistence that normalization is treason and that support for Gaza should be without limits—it seems that the military judiciary has a different opinion!

The imprisonment of Ustaaz Mohamed Nasser Chouikha pending an investigative case, in which he faces criminal charges—some of which carry a life sentence—based on the interpretation of certain sentences and phrases from his article to fit a predetermined conviction, is a blatant violation of the country’s political trajectory and its laws. Constitutionally, Tunisia is part of the Islamic Ummah, and what affects the Ummah concerns every individual. Moreover, the military court has no jurisdiction over prosecuting civilians unless a military personnel member is involved. Decree No. 87, which regulates political parties, exclusively grants the Prime Minister the authority to hold political parties accountable. Furthermore, Decree No. 115, which repealed the Press Law, protects journalists and authors of published articles in periodicals from such prosecutions.

Accordingly, the oppression of Muslims, their subjugation, and the violation of their blood, wealth, and honor—coupled with the silencing of their voices to prevent them from exposing the truth and calling things by their real names—constitute an injustice beyond compare. Moreover, the oppression inflicted by one’s own people is even more painful. It must also be remembered that enjoining good and forbidding evil neither hastens death nor diminishes sustenance.
