Regimes are not Guarded by Emergency Laws, but are Guarded by Justice
(Translated)

Based on the state of emergency imposed by President al-Bashir on Friday, 22/02/2019, he began issuing emergency orders and has now reached five orders. Are these orders, and what follows them, the solution to the crisis existing in the country, or is it an attempt to silence the mouths, and prevent people from accounting the regime on its actions, which brought Sudan to this miserable situation in various walks of life?!

The one who views these orders will see that they are security treatments only! The purpose of which is to preserve the wilted chairs of the regime and their bases, and has nothing to do with the treatment of the crises of hell lived by the people, which is illustrated in the following:

1. The release of the regime’s forces to terrorize people and arrest them, and the seizure of funds and objects once suspected, not by definitive evidence, is the law of the jungle, which violates the law of Islam that prohibits arresting people based on suspicions, ‘Aisha (RadhiyaAllahu ‘Anha) said: the Messenger of Allah (saw):

«ادْرَءُوا الْحُدُودَ عَنِ الْمُسْلِمِينَ مَا اسْتَطَعْتُمْ؛ فَإِنْ كَانَ لَهُ مَخْرَجٌ، فَخَلُّوا سَبِيلَهُ، فَإِنَّ الإِمَامَ أَنْ يُخْطِئَ فِي الْعَفْوِ، خَيْرٌ مِنْ أَنْ يُخْطِئَ فِي الْعُقُوبَةِ»

“Avoid legal punishments upon the Muslims as much as you are able. If you find a way out for a Muslim, then leave it to him. Verily, for the judge to make a mistake pardoning the Muslims is better than to make a mistake punishing them.”

2. Preventing gatherings and assembling, as well as banning the holding of seminars, various events and activities, except with the permission of the Authority (which never gives permission) for such acts is a method of silencing the mouths and preventing the accountability of the regime for its crimes. Ibn Mas’oud (RadhiyaAllahu ‘Anhu) reported that the Messenger of Allah (saw) said:

«... كَلاَّ وَاللهِ لَتَأمُرُنَّ بالمَعْرُوفِ، وَلَتَنْهَوُنَّ عَنِ المُنْكَرِ، وَلَتَأخُذُنَّ عَلَى يَدِ الظَّالِمِ، وَلَتَأطِرُنَّهُ عَلَى الحَقِّ أطْراً، وَلَتَقْصُرُنَّه عَلَى الحَقِّ قَصْراً، أَوْ لَيَضْرِبَنَّ اللهُ بقُلُوبِ بَعْضِكُمْ عَلَى بَعْضٍ، ثُمَّ ليَلْعَننكُمْ كَمَا لَعَنَهُمْ»

“Nay, by Allah, you either enjoin good and forbid evil and catch hold of the hand of the oppressor and persuade him to act justly and stick to the truth, or, Allah will involve the hearts of some of you with the hearts of others and will curse you as He had cursed them”. [Abu Dawud and At-Tirmidhi].

3. In principle, there is no difference between the laws emanating from the constitution that has been suspended, and the emergency orders, since they are all based on the whims of men (man-made), while we are primarily Muslims. Our constitution and laws must be based on the provisions of our faith, these laws do not need emergency or anything else, as they are issued by the Lord of the Worlds who knows what benefits people and what harms them:

﴿أَلَا يَعْلَمُ مَنْ خَلَقَ وَهُوَ اللَّطِيفُ الْخَبِيرُ﴾

“Should He not know what He created? And He is the Subtile, the Aware.” [67:14]

We in Hizb ut Tahrir / Wilayah of Sudan, confirm that this regime that has lost direction, is still dazzled in its error, does not like advice and advisors, and does not respond to the faithful. It thinks that by these emergency orders it has protected itself. It does not know or does not want to know that regimes are not guarded by security armies, or emergency laws, but are guarded by justice:

﴿الَّذِينَ آمَنُوا وَلَمْ يَلْبِسُوا إِيمَانَهُمْ بِظُلْمٍ أُولَئِكَ لَهُمُ الأَمْنُ وَهُمْ مُهْتَدُونَ﴾

“Those who have attained to faith, and who have not obscured their faith by wrongdoing-it is they who shall be secure, since it is they who have found the right path!” [6:82], which is exclusively in Islam and in its rulings, it is the mercy that the beloved (saw) was sent with:

﴿وَمَا أَرْسَلْنَاكَ إِلا رَحْمَةً لِلْعَالَمِينَ﴾

“We sent thee not, but as a Mercy for all creatures.” [21:107]. The faithful sons of this Ummah should catch hold of the hand of the rulers in this country and work with those working to return it, a Khilafah Rashidah (rightly guided Caliphate) on the method of the Prophethood. It is the only one capable of solving all the problems of the country and even the problems of the stray world.

﴿يَا أَيُّهَا الَّذِينَ آمَنُوا اسْتَجِيبُوا لِلَّهِ وَلِلرَّسُولِ إِذَا دَعَاكُمْ لِمَا يُحْيِيكُمْ﴾

“O you who Believe! Respond to the call of Allah and the Apostle whenever he calls you unto that which will give you life; and know that Allah intervenes between man and [the desires of] his heart, and that unto Him you shall be gathered.” [8:24]
