How Can Islamic Groups Support a Secular Constitution?!
(Translated)

In a joint statement from the People’s Congress Party and Ansar al-Sunna Muhammadiyah - General Center, the two parties supported the political settlement on the constitutional basis; initiated by the group that was organized at the House of the Lawyers Association, and they called on all national forces to support this settlement. In their statement, the two parties emphasized that freedom and consultation are inspiring principles for intellectual and political growth and development, and that democracy is a moderate approach to the peaceful transfer of power that allows citizenship for all the people of the country without discrimination or differences.

Don’t the honorable brothers in the People’s Congress and Ansar al-Sunna Muhammadiyah - the General Center know that the constitutional basis that they supported, and called on others to rally around the settlement on its basis, is a purely secular constitution? Its basis is to separate religion from life and politics?!

If they do not know, then we in Hizb ut Tahrir / Wilayah Sudan, and as a matter of advice, state the following facts about the above-mentioned constitution (the Constitution of the Steering Committee of the Lawyer Association):

First: This constitution was not based on the Islamic Aqeedah, which is the faith of the people of Sudan. Rather, it was based on the Western foundation in drafting constitutions. It is the separation of religion from life, and consequently its separation from politics, and this is a false basis, and what is built on falsehood is false. Allah Almighty says:

[أَفَمَنْ أَسَّسَ بُنْيَانَهُ عَلَى تَقْوَى مِنَ اللَّهِ وَرِضْوَانٍ خَيْرٌ أَم مَّنْ أَسَّسَ بُنْيَانَهُ عَلَىَ شَفَا جُرُفٍ هَارٍ فَانْهَارَ بِهِ فِي نَارِ جَهَنَّمَ وَاللَّهُ لاَ يَهْدِي الْقَوْمَ الظَّالِمِينَ]

“Which is better: those who laid the foundation of their building on the fear and pleasure of Allah, or those who did so on the edge of a crumbling cliff that tumbled down with them into the Fire of Hell? And Allah does not guide the wrongdoing people.” [At-Tawbah 9:109].

Second: Article 1 of this constitutional draft stated that Sudan is a federal democratic state in which cultures, ethnicities, languages, sects and religions are diverse. Democracy is a system of kufr (infidelity), which makes sovereignty for the people and not for the law, so it is forbidden to take it, or to call for it, and it is a system based on giving the right of Allah Almighty to legislate for humans, so they legislate what Allah Almighty did not authorize! As Muslims, we are bound by the law of Allah Almighty, who says:

[أَفَحُكْمَ الْجَاهِلِيَّةِ يَبْغُونَ وَمَنْ أَحْسَنُ مِنَ اللَّهِ حُكْماً لِّقَوْمٍ يُوقِنُونَ]

“Is it the judgment of ˹pre-Islamic˺ ignorance they seek? Who could be a better judge than Allah for people of sure faith?” [Al-Ma’idah 5:50].

As for federalism, it is the shredding machine through which Sudan is meant to be torn apart. It also began with the separation of South Sudan. The basic principle in the system of government in Islam is that it is a unit system and not a federal system, in which the sovereignty of the Sharia and the authority in it is for the Ummah.

Third: It is also stated in Article One... Rights and duties are presented in it on the basis of citizenship. The rights and duties in Islam are determined by the Sharia. Allah Almighty says:

[وَمَا كَانَ لِمُؤْمِنٍ وَلا مُؤْمِنَةٍ إِذَا قَضَى اللَّهُ وَرَسُولُهُ أَمْراً أَن يَكُونَ لَهُمُ الْخِيَرَةُ مِنْ أَمْرِهِمْ وَمَن يَعْصِ اللَّهَ وَرَسُولَهُ فَقَدْ ضَلَّ ضَلالاً مُّبِيناً]

“It is not for a believing man or woman—when Allah and His Messenger decree a matter—to have any other choice in that matter.¹ Indeed, whoever disobeys Allah and His Messenger has clearly gone ˹far˺ astray.” [Al-Ahzab 33:36].

Fourth: The settlement on the basis of this secular constitution that separates religion from life, serves the project of the colonial kufr in our country, and prevents us from Islam. It suffices that America, Britain, France and other kufr countries and their followers at home and abroad support this constitution and the settlement on its basis, to pass their projects; a war against the remaining legal provisions in legislation and laws, by signing CEDAW, normalization with the Jewish entity, plundering the country's wealth, and expropriating its land.

In conclusion: Islam has defined the system of the Khilafah (Caliphate) and it will return soon, if Allah Almighty wants, and we call on our brothers to work with us in order to establish it; a Khilafah Rashidah on the method of the Prophethood, cutting off the roots of the unbelievers, and returning their plots to their faces. The Prophet (saw) gave the good tidings that the Khilafah will return to righteousness after the forced rule in which we live in the last days, Allah Almighty said: «ثُمَّ تَكُونُ مُلْكاً جَبْرِيَّةً فَتَكُونُ مَا شَاءَ اللَّهُ أَنْ تَكُونَ، ثُمَّ يَرْفَعُهَا إِذَا شَاءَ أَنْ يَرْفَعَهَا، ثُمَّ تَكُونُ خِلَافَةً عَلَى مِنْهَاجِ النُّبُوَّةِ، ثُمَّ سَكَتَ»“Then there will be an oppressive rule, and it will last for as long as Allah wishes, then He will lift it if He wishes. Then there will be a Khilafah on the method of Prophethood. Then he (saw) fell silent”.
