Arrest of Those Who Enjoin the Good and Forbid the Evil Its Consequences is a Disgrace in this World and Severe Punishment in the Hereafter
(Translated)

During the distribution of the leaflet entitled: "The Ruling of Apostasy and the Issue of Implementing Shariah law... An Enemy Ready to Attack... Defeated Rulers... An Aspired Ummah... A Genuine Party... And the Good Fate is for the God Fearing" which was published by Hizb ut Tahrir/Wilayah of Sudan today, Friday 23/05/2014 CE, after the Friday prayer in Al-Ateeq Masjid in Gararif City, the Head of the Gadarif City District ordered the arrest of one of the members of Hizb ut Tahrir. This prompted Brother Musa Mohammad Noor (41 years old) who is a member of Hizb ut Tahrir to intervene in defence of his brother by the tongue, and explaining the prohibition of such a measure by Shari'. This infuriated the Head of the District who seized Brother Musa by the collar and ordered his arrest, he was then taken to the police station. Two charges were issued against him under Articles 47 and 99 of the Criminal Law. As a punishment, the state institutions which are supposed to be just, are delaying his release on bail.

Regarding this measure, which is typical of the regime and its war on Islam, we in Hizb ut Tahrir/Wilayah of Sudan confirm the following facts:

First: The leaflet that was widely distributed in the masjids of the Capital and the Provinces including Gadarif by Hizb ut Tahrir/Wilayah of Sudan, explains the Shariah Ruling on the issue of apostasy, and confirms the a Muslim is proud of his creed and by his Shariah rules and is not embarrassed by them, because this achieves the spiritual value which testifies to the worship to Almighty Allah. The leaflet also exposes the disgraceful position of the rulers towards the ruling of apostasy that was issued on a woman who apostatized from Islam. The leaflet also revealed the hostility of the Kaffir West on Islam and the Muslims, it also confirmed that the Islamic Ummah by the grace of Allah has recovered from its defeatism and is aspiring to see the resumption of the Islamic way of life through the implementation of all the systems and rules of Islam under the rightly guided Khilafah "Caliphate" which is coming soon by the permission of Allah. In the end of the leaflet, it asked the Muslims to work with Hizb ut Tahrir, the leader that do not deceive its people, to establish the Khilafah "Caliphate" that will implement the Shari' of Allah under the leadership of the Ameer the eminent Scholar Ata Bin Khalil Abu Al-Rashtah.

Second: The actions of the Head of Gadarif District represents one of the examples of this corrupt regime, where the official who is responsible for the security and looking after the affairs of the people and guides them to the truth and good. In this case, it is the Head of the District, does so by the exploitation of the law, and terrorizing the security of people, and attempts to strike fear in the carriers of the Dawah who enjoin the good and forbid the evil, and work to reform what was corrupted by the corrupt.

Third: Article 99 of the Criminal Law which states: "The one who stops a public officer, or attacks him, or uses the criminal force to obstruct him from carrying out his duties and job, or by carrying out these duties is punished with less than six month imprisonment, or with a fine, or with both punishments." This article is no way near what our Brother Musa did and does not apply to it, his action was in response to the command of Allah (swt) and His Messenger (saw) that says:

«انْصُرْ أَخَاكَ ظَالِمًا أَوْ مَظْلُومًا فَقَالَ رَجُلٌ يَا رَسُولَ اللَّهِ أَنْصُرُهُ إِذَا كَانَ مَظْلُومًا أَفَرَأَيْتَ إِذَا كَانَ ظَالِمًا كَيْفَ أَنْصُرُهُ قَالَ تَحْجُزُهُ أَوْ تَمْنَعُهُ مِنْ الظُّلْمِ فَإِنَّ ذَلِكَ نَصْرُهُ»

"Support your brother when he is the oppressor or when he is oppressed, a man said, O Messenger of Allah, I support him when he is oppressed, but if he is the oppressor how can I support him? He (saw) said: Stop him from committing Oppression, this is how you can support him." (Extracted by Bukhari in his Sahih)

Finally: We say to the regime and its henchmen, that oppression and terrorism will only add to the strength of the members of Hizb ut Tahrir in holding on to the truth, which they are working to find on the ground, and it will only add to your disgrace in the Dunya and a severe punishment in the Akhira.

Allah (swt) says:

(وَلا تَقْعُدُوا بِكُلِّ صِرَاطٍ تُوعِدُونَ وَتَصُدُّونَ عَنْ سَبِيلِ اللَّهِ مَنْ آمَنَ بِهِ وَتَبْغُونَهَا عِوَجًا)

"And squat not on every road breathing threats hindering from the path of Allah those who believe in Him and seeking in it something crooked" [Al-Araf: 86].
