Secularization of Family Laws is Part of the Policy of the Corrupt Regimes in Islamic Countries

 After the Western Kafir succeeded in abolishing the Ottoman Caliphate and establishing weak states in the Islamic countries, he doubled his efforts to secularize societies in the Muslim countries to make the people embrace its ideology as embraced by the regimes. It spent billions of dollars and established and supported local and international human rights organizations such as the feminist movement “Gender Feminism” to devise laws of decadence and to work to codify it internationally or through the corruption junta who are ruling and legislating in our country, targeting the Muslim family and its main components women (mother, wife, daughter) under the names of personal freedom, equality, women's reproductive health, etc...

We have found a shameful decline lurking in the culture of the Ummah and nothing is preventing its acceleration except the fear of the firm rejection by the Ummah and the exposure of the reformist intentions. The Convention on the Elimination of All Forms of Discrimination against Women - CEDAW – is only one such example, which was signed by almost all the Arab countries. Egypt was the first country to sign it in 1981, and the last of which was the Palestinian Authority in 2009. These signatory States undertook to submit an annual report on the legislative, judicial, administrative and other measures taken to implement this Convention and the progress achieved in this regard (As provided for in Article 18 of this Convention).

Looking at the agenda of CEDAW and other international conventions, such as the Convention on the Rights of the Child (CRC), we find them all targeting the family and its constituents in a heinous manner that is not compatible with the human nature (Fitra) or the law of Ar-Rahman. It includes working to eliminate the stereotyped form of the family (father, mother and children) to ensure the right of homosexuality and non-criminalizing it, disseminate sexual education in schools, strengthen the rights of children by lifting the authority of parents, activate mechanisms to deprive the family of its functions by challenging guardianship and to integrate the mother into development with the aim of harming maternity duties.

Women's rights institutions continue to work diligently and actively to activate all the decisions more quickly and pass them through legislative councils. In Palestine, the Palestinian Authority (PA) established the Ministry of Women's Affairs in 2003, and its stated mission is: to integrate gender issues into various national policies, programs and plans. (The Arab Intellectual Forum 2003 p. 84).

This gave rise to women's institutions striving to spread awareness on it among the public, and the struggle of decision makers to achieve gender equality in accordance with the CEDAW document. In addition, the General Union of Palestinian Women and issued a document on women's rights in 1994 in cooperation with the Coordinating Committee for the Advancement of Women which is in full harmony with Beijing document. (Palestinian Chronicle, June 2004, Issue 49). The campaign for Palestinian family law has achieved some legislative targets in:

1 - The adoption of Law No. 12 of 2005, which stipulates that women must be involved in political work and legislative elections, in electing, candidacy and seats.

2 - The Cabinet Decision No. 14 of 2003 on women’s work at night from 20.00 to 06.00 if they were working in hotels, restaurants, theaters, cinemas, music halls, hospitals, clinics, pharmacies and the like.

3 - Circular No. 3/2611 issued by Passports and Nationality Department on 2/3/1996, stipulating the non-requirement of the husband’s or the guardian’s consent to the wife, or to the daughter who is above the age of 18 to obtain a Palestinian passport. And Article 10 and 11 of the amended Palestinian law provides that the Authority shall act without delay to accede to regional and international declarations and charters that protect human rights, including personal freedom as a guaranteed natural right. In Egypt, however, the legal amendments to the Muslim family have caused corruption in its firm bond, which had contributed to further deterioration at the social level. The writer Adel Amer in an article on the Diwan Al Arab website entitled "The corrupt laws of Egypt", published on June 3, 2012 said: (95% of the laws are contrary to the Islamic law, and this was reflected in the increase of customary marriage, divorce and broken families. There are unjust laws that must be seriously pursued to be change in accordance with the sharia. The most important of which are: the Khula’ law of article 20 of 2000, the re-uniting (Ruju') act within 66 days, the law of the age of custody which reached 15 years, and the unjust vision law which deprived the father of caring for his children and forbade the grandparents from seeing their grandchildren as well as the uncle and aunt. And the law of the educational guardianship of the custodian, the non-requirement of the husband's consent for the wife's travel, and the permission of wife who gives birth from other than her husband to register the child without the father's name).

The total number of customary (marriage) cases for the year 2014 in Egypt reached 88 thousand cases (Youm7, 4 December 2017). More than a quarter of a million cases of separations in 2015 are due to the misuse of the Khula’ law, according to the Russian RT website published on 6 December 2016, under the title "Egypt is the world's first in cases of divorce".

In addition the age of marriage for the wife was determined to 18 years, as it is in force in Egypt, as well as in Jordan according to Article 7 of the amended Jordanian Personal Status Law (Al-Rai Newspaper on 18/7/2017), and work is under way in Palestine to adopt it on the pretext of fighting early marriage and family disintegration.

With regard to the right to homosexuality, there is no law in the PA, Jordan or Egypt that denies or criminalizes "homosexuality" as long as it is consensual!! On 23 September 2017, Egypt witnessed a festival of homosexuals in which thousands participated and the flags of pride were raised in full view and protection by the authorities. In Jordan, several events for a homosexuals Night Project were organized; the largest of which was on 14 August 2015 on the Roman Amphitheater in Jerash in addition to other parties, and apart from those prevented by the authorities to prevent provocation of public opinion. The Jordanian Prince, Zeid bin Raad, who assumed his functions as United Nations High Commissioner for Human Rights in September 2014 presented more than twenty proposals to provide legal protection for homosexual couples (Amman.Net - 3/6/2015).

These are some of the examples and events in which the organs of the crooked and corrupt regimes have joined to descend the Ummah towards a culture of dissolution, immorality and disintegration through the media, school programs and activities, legal amendments, and support of women's human rights organizations for the gender project in order to uproot the Islam's culture, morals and high values and to replace them with the culture of CEDAW and its sisters gradually. The tampering hands with the culture of our sons and daughters and the cohesion of our families and the purity of the ideas of the society will only be stopped by the uprooting of these rotten regimes, and replacing them with the Khilafah Rashidah (righteous Caliphate) on the method of the Prophethood. That Khilafah that promotes goodness and purity, closes the doors of evil and oppression, and protects individuals and the family from everything that undermines its foundations, entity and strength, and all that threatens its stability and bliss. Those who do wrong and disobey will come to know by what a great reverse they will be overturned.

Allah (swt) says:

﴿إِنَّ الَّذِينَ كَفَرُوا يُنفِقُونَ أَمْوَالَهُمْ لِيَصُدُّوا عَن سَبِيلِ اللَّهِ فَسَيُنفِقُونَهَا ثُمَّ تَكُونُ عَلَيْهِمْ حَسْرَةً ثُمَّ يُغْلَبُونَ وَالَّذِينَ كَفَرُوا إِلَىٰ جَهَنَّمَ يُحْشَرُونَ

“Verily, those who disbelieve spend their wealth to hinder (men) from the Path of Allah, and so will they continue to spend it; but in the end it will become an anguish for them. Then they will be overcome. And those who disbelieve will be gathered unto Hell.” [Al-Anfal: 36]
